Beyond that, does society need to cast additional chills on freedom of speech and spirited public discourse, to combat hatred? In the Star’s view, no.

But a controversial section of the Canadian Human Rights Act does just that. Section 13 makes it a “discriminatory practice” to communicate “any matter that is likely to expose a person or persons to hatred or contempt” via the Internet. That can be interpreted to cover defaming or stereotyping, a wider net than inciting hatred. Unlike the Criminal Code, there’s no need to prove intent. And the penalty is serious. The federal rights tribunal can order the offending party to desist, to smarten up, and to pay as much as $30,000 in damages and penalties.

After picking my jaw off the floor I realized that this is pretty much the end of any support for s. 13. When the house organ for the Toronto Party advocates repeal the only thing saving s.13 is the inertia of the CPC and Harper’s PMO.

    Ah Jay et al,

    WE are winning and if Frieman’s article in the G&M today is any indication, the remaining defenders of the CHRC and 13.1 are fighting a rearguard action with only hugs in the cold left.

    The last few days has seen major articles in the MSM from coast to coast and all condemming Sec. 13.1 and the privledgd few especially “Lucy”.

    Now that we are close to achieving a small victory no one believed possible even 1 year ago – a complete judical review of the actions of the CHRC, CHRT and the Intervenors must be accompanied by a police investigation for even the rather lax rules and practices of the CHRC & the CHRT do not allow for tampering with evidence, perjury and what is know elsewhere as subverting the course of justice.

    What we have here is a failure to communicate :)

    Charge. Them. All – & then Fire them.

    Yeah, Hurrah is so brave. Dude, I’m a size 8. If that’s chubby, you’re confused. Not sure how many nobodies have books chosen as Conservative Book Club selections, or blogs with thousands of daily readers, but hey, we’ve established that you’re not that bright.
