Kinsella joins the fray
Mark Steyn posts to inform us that Warren Kinsella, likely put out at the attention Richard Warman has garnered with his litigation, has filed a joint libel action against Free Dominion.
From a guy who has flat out said that Chris Selley links to “crypto-Nazis” this is more than a bit cheeky.
It will, however, be interesting if it goes to Court as the alleged libel seems to be that FD accused Warman and Kinsella of “Nazi-like behaviour”. Whatever could that mean? I can think of several things but libel chill is a terrible thing and I don’t have the time to frame them in certifiably non-libelous language.
Instead two comments: first it is good to have Warman and Kinsella sharing top billing on a Writ as it makes their connection crystal clear. Second, the weakness of this claim underscores the fact these are primarily political pieces of litigation.
The push back against the Chekists at the CHRC and their supporters has reduced those supporters to trying to silence the opposition by force of law. It would be interesting to know who is funding this attempt.
Meanwhile, Connie and Mark over at Free Dominion are going to need even more money to defend themselves against this legal assault. Go here to give.

Wonderful, it is good that these 2 publicly and politically marginalized anti-democratic extremists be exposed to the public – by their own hand yet.

As another blogger opined, this is act of desperation. When you see Wornout hanging with the likes of Lucy you realize his best days are long behind hid him. Hope the old cooter has some swag stashed for the counter suits.

Yes, I can see that we will have to get the politicians to give SLAPP litigating the same treatment as section 13(1)as they are both connected in repressing free expression of political commentary.

Well, that’s certainly carrying on the brave traditions of punk rock… reaching for the libel writs. Sid Vicious would be proud (see R v Ritchie; Ex parte R [1977] AC 666).

May not we all put political comment to music (well, perhaps loud rhythmic noise would do), in order to avail ourselves of the comfort to be found in a kind of creative license that permits giving voice to some of our more opprobrious thoughts?

What Kinsella in particular has said about the FD and other sites is much nastier, including accusations of being Nazis, than anything in the posting they cite in their filing. A judge can’t be trusted to do so, but Grandma would tell one child who complains about being called a name by a sibling that “You asked for it.”
A trash talker with a thin skin is very useful, not unlike the planting of evidence as his buddy does. In the category of planted evidence, do we really know … maybe his buddy drew the boys washroom swastika that he posted a picture of? Thanks to themselves we don’t know what to trust.
