Dead Men Walking

The cold, miserable truth is that both our major political parties are corpses, their original purposes long forgotten, their loyal members driven away or sidelined, their traditional voters taken for granted. Every so often, by a mysterious process, one of them is declared electable and the other is declared unelectable. And we, the voters, do as we are told. By whom? For what purpose? peter hitchens, mail on sunday

Apparently, in Canada, October is the cruelest month. The naked truth of our political bankruptcy is to be exposed like a bag of sub-prime mortgages.

I hear the SCC call, inter alia…the Lying Jackal and Lucy

An individual’s reputation is not to be treated as regrettable but unavoidable road kill on the highway of public controversy, but nor should an overly solicitous regard for personal reputation be permitted to “chill” freewheeling debate on matters of public interest. supreme court of canada

We no longer live in the world of “gentlemen’s clubs” or regimental messes where, to write an NSF cheque got you a room with a table and a gun in the drawer. Contra the LyingJackal, a slight is not a law suit and, at last, the SCC is bring a degree of the Sullivan rules into Canadian defamation law.

Basic takeaway: enter the arena and you ply by rules rather different from those of private life.

Investigative reports get “spiked”, it is contended, because, while true, they are based on facts that are difficult to establish according to rules of evidence. When controversies erupt, statements of claim often follow as night follows day, not only in serious claims (as here) but in actions launched simply for the purpose of intimidation. supreme court of canada

Not a good day for the libel warriors; rather a good day for free speechers.

Update: Reading further Rothstein, Jis quoted in the headnote:

To satisfy the fair comment defence, there is no requirement to prove objective honest belief. The defence of fair comment should only require the defendant to prove (a) that the statement constituted comment, (b) that it had a basis in true facts and (c) that it concerned a matter of public interest. scc

Let’s see: assorted defendants commented on the disgusting nature of the Anne Cools post, they relied on a factually pattern of behaviour which included posting under pseudonyms, and they commented, rather negatively, on the behaviour of a person who would publish such nasty stuff.

Hmmm…I am liking the Canuck 6’s chances a lot more than I did yesterday.

Dumbass

Prime Minister Stephen Harper has accepted the resignation of his embattled foreign affairs minister over an apparent security breach involving cabinet documents.

Mr. Harper told an extraordinary new conference on Parliament Hill that Maxime Bernier’s controversial relationship with a woman linked to the Hells Angels was not a factor in the decision.

But the resignation came as Julie Couillard was about to go to air on the French-language television station TVA to say that her former lover was careless with classified documents.

The Prime Minister says Mr. Bernier failed to uphold his promise to protect cabinet confidences. globe and mail

Hey, it could happen to anyone…have a few pops, have the chrome sucked off your bumper, forget your briefcase…but anyone is not supposed to be the Minister of External Affairs.

Nice to see David Emerson step into the breach. Harper finally goes for clued in rather than the optics.

Jason and the Lying Jackal

A great post over at Enjoy Every Sandwich.

The problem is that while Jason is not terrifically bright, the Lying Jackal combines dumb with ruthless. Jason didn’t know that. Those of us who have been called “crypto-Nazis” by the Jackal do.

Basic strategy Jason, when the Jackal attacks here are the magic words, “Fuck off you Nazi”. He will then sue you and beclown himself…again.

Break out the Beer and Popcorn

Canada’s dumbest Liberal, Jason Cherniak, desperate to wedge his nose just a little further up M. Dion’s derriere has just accused the Lying Jackal of criticizing M. Dion’s brilliant (won’t raise the price of gas a penny, no, really) carbon tax because the Lying Jackal lies on behalf of energy companies who are Daisy’s clients.

The comments are hilarious.

Dawg and the Liar Kinsella…Pwnd

Dr. Dawg and the Liar Kinsella posted a pic they stated was Marc Lemire standing behind Ernst Zundel. Lemire is calling bullshit.

That picture is not me at all. In August 1992, I had never met Ernst Zundel.

In August 1992 I was only 17 years old.
I searched around, and haven’t yet found a picture of me in 1992, but did find one a year later in the summer of 1993. Sadly the red-eye reduction wasn’t working that day :) freedomsite

Comments gents? Did you properly source the photo?

I have noticed that Marc Lemire tends to be right about stuff like this.

Update: While I think the pictures speak for themselves I have sent an email to Nizkor asking for more information on the Zundel photograph. I’ll report any response.

Update IIKen McVay from nizkor has replied to my query as follows:

Lemire may be right, and I no longer identify the image as his because
of his insistance that it isn’t him.

I haven’t seen Marc for 11 years, so cannot contest his assertion that
it isn’t him.

Not proof either way but nizkor is certainly not standing behind the attribution.

Update III: Dawg graciously withdraws his assertion that Lemire is in the frame with Zundel:

**UPDATE: (March 31) As noted here, Nizkor cannot vouch for the authenticity of the photograph. Obviously, in that case, neither can I. I withdraw, therefore, the assertion that Marc Lemire is pictured in the photograph above. dr. dawg

A gentleman. Now we can, of course, anticipate the liar Kinsella’s retraction….Yeah, right.

Farce

The Liberals rely on a book which purports to have the inside scoop on a CPC attempt to bribe Chuck Cadman for his vote to bring down the Martin government. The Liberal Party website reports the “bribery” as fact and adds that Harper knew. Harper sues. The widow Cadman now says that so far as she knew Harper didn’t.

My own thought is that this whole thing was a fairly well planned Liberal smear which was calculated to hit just in time for the early Spring election that Dion and the Liberals were too wimpy to force. The thing about a smear during an election is that the exact truth does not matter; what you are looking for is a two week sensation your pals in the Liberal media can run with. But without an election a smear can turn into a disaster as it is investigated. And the CPC is very smart indeed suing the Liberal Party. That party is very close to broke whereas the Tories are awash in cash. A couple of hundred dollars on a libel defence plus the very real possibility of serious damages will have the few remaining adults in the Party demanding some serious accountability.

Who the National Post should have Hired

Kathy Shaidle has an excellent piece in today’s National Post on the hypocrisies of the CPC on the free speech issue. So, Posties, finally the liar Kinsella is gone. Time to hire someone who writes from the right rather than the Beaches left.

Cherniak is not amused

The issue with Kate McMillan’s “prank” is not that it was using the Holocaust as a joke. The issue was that her joke made Holocaust survivors, who deserve nothing but our deepest respect, as the punch line. That is simply inexcusable. jason cherniak

Fresh from his double triumph of accusing Christians of wanting to slaughter non-Christians to bring forth the Messiah and reviving the old “Jews control the media” meme you’d think Cherniak would try the think before you type method. You’d think wrong.

The punch line, Jason, is that Kinsella’s faux Nazi hunting, brute ignorance and willingness to use what he believed was a Holocaust survivor to boost his bogus arguments has been exposed.

I am hoping that Kinsella learns something from his humiliation. For example, he might learn that calling people “bigots” or “crypto-Nazis” without a shred of proof can turn out badly. He might learn that using fake names, sock puppets, agent provocateurs in sting operations is not a sign of bravery but rather of craven cowardice. And, with luck, Kinsella might even clue into the fact that the real enemy of the Jews and the West are not a bunch of neo-Nazi losers in Mum’s basement - rather it is militant Islam.

Bye…

Looks like the liar Kinsella couldn’t stand the heat and is getting out of the kitchen. He is taking his own special brand of dumbed down Nazi hunting (disagree with the Kinsella view: you’re a Nazi) off to the Canadian Jewish Congress.

What the CJC has done to deserve this - other than giving Lucy Warman an award - is not clear. Putting a laughingstock on your legal affairs committee takes loyalty to a new extreme.

But it will be a better fit. The CJC likes s.13 of the Human Rights Act, the National Post and most of the newspapers in Canada do not. With Kinsella on the prowl, the nation’s public conveniences will, no doubt, prove fertile ground for s.13 complaints.

Kinsella’s last comment of the day invoking the real horror of real Nazis simply underscores what a trivial nuisance this vile little man has become. To use real suffering to justify the faux politicized outrage Kinsella peddles is despicable. The Post is well rid of him.

Update: And did I mention slipshod and sloppy?

Legal Sprouts

I see the anonymous masterminds behind Law Is Cool have now sunk their baby teeth into Jay Currie. You’d think the poor touchy little things would have realized they were way out of their depth by this point, but instead their ripostes are getting even more fantastically pompous mark steyn

Bring it on indeed! Thanks for the link Mark.

I have been seriously thinking about applying for intervenor status should the British Columbia Human Rights Commission take up these loonies’ complaint against Mark. Anyone who cares about freedom of speech needs to recognize that these sorts of tactics need to be resisted and, more importantly, attacked.

I’ve no doubt that Mark and Mcleans will run the full constitutional argument before the respective Human Rights Commissions and, down the road, before the rather more reasonable people who sit as judges in, well, Courts.

Meanwhile, one can only hope the legal sprouts will sue me. Or complain about the Dutch fireworks ad. Mind you, I can’t even get the liar Kinsella to sue me no matter how often I call him a liar…so I fear the sprouts at lawiscool are not likely to drop a writ.

Hey, buddy

So there was this guy, see. Heavy dude. I needed a bit of advice. I needed to get hooked up to the guys who do the deals. So I hired the guy.

Expensive? You bet. You get what you pay for. And this dude dances with the gal who brung him.

Kinda funny about the thousands. Nice for bulk. Not made any more. Too bad. Keeps the envelope thinner.

Pretty damn thick even at that. the last 10k was in fifties and I cannot tell you how bulky they are.

Nah, no meeting, just a cup of coffee. Ya know he quit drinking, poor bugger.

Look, he was jonesing for a cash hit. That job? Chump change. A few years of that and a bit of a shoe habit and, well, your broke. He was cash poor. I fixed that.

Hey, look, there are hedge guys who make that an hour. So what the fuck are you talking about? This is chickenshit. You take a look at what he makes at that goldmine. A lot of Munky business if you ask me.

Look little Canadian pussy, this is how the world works. He knows. I know. You have not the faintest clue.

Deadly Design

ROM Crystal

Paul Wells points to a Globe and Mail article which suggests the ROM new wing, well, leaks.

I spent several years of my life just down the street and I suspect that leaks are the least of the ROM’s worries. Here’s a surprise. It snows on Bloor Street. And there is wind. Stuff - and chaps staggering back from the Duke - freezes. Then it thaws. Then it slides down the hundred feet of glass and kills every single one of Miss Smith’s first grade class.

If you live in Vancouver and walk into the Courthouse you get dripped on. Do the same thing in April at the ROM and you risk the icicle to the top of the head or a ton and a half of semi-frozen snow avalanching on your noggin.

A very rare bird - Mark Carney

“He is really sharp, he cuts to the chase. There’s no bullshit about him,” the banker said. “I like him. He rubs some people the wrong way … he’s a little bit cocky,” he said. reuters

Mark Carney, economics PhD, Harvard, Oxford, Goldman Sachs, 42 - all that Iggy had but twenty years younger and with serious, earned, money and the next Governor of the Bank of Canada…hmm, bet he speaks French. (Yup, “Carney had to hone his French after arriving in Ottawa to meet the bilingual demands of public service” Bloomberg)

Which would mean, assuming that Harper either wins a majority or hits the minority wall, our man Mark in three years can switch to the politically pointy end of public service for either the CPC or the Liberals. And, given that Harper appointed him over the head of a 35 year vet, I can’t but think that the CPC might be the ticket.

The Kinsella Death Spiral

Mr. K continues his feud with Chris Selly by accusing him of nasty linking. I’ll just quote the odious little liar so you won’t have to slime your browser going to his site (which I did take a screen shot of as Mr. K is happy to rewrite history).

Because he links to bigots who promote that old anti-Semitic canard, the “kosher tax”; a woman who calls for genocide in Africa; and another guy who calls himself a “bigot”. He’s a tit, in other words. And I still don’t understand why Adam hired him.

I’m the bigot guy and if you are really interested you can go over to James Bow’s discussion of my usage. Mr. K remains irony challenged.

Joining me in the links of hate list are my friend Kevin Michael Grace (”kosher tax”) and Kate MacMillan of Small Dead Animals. Interestingly Kinsella cannot find Grace’s original article and instead relies upon reports of Kevin’s article published on Usenet. I suspect that Kinsella’s use of the word “promote” in this instance is actionable. Indeed, having read the article in question, I could find no “promotion” of the anti-Semitic canard of the kosher tax if only because the words “kosher tax” nowhere appear in that article. And it is typical of Kinsella that he smears on no evidence and in the face of the face (know to Kinsella) that KMG is perhaps the only person in Canada to have been positively vetted by the Canadian Human Rights Commission as not anti-Semitic. I hope Kevin will be publishing chapter and verse on that.

His smear of Kate is, if anything, even more despicable. “a woman who calls for genocide”. Here is what Kate wrote:

“Is there a point where we are allowed to stop feeling sympathy for these people, seal off the borders and just let nature take its course?” SDA note, the liar Kinsella linked to a rather nasty anti-Kate site not being able to find the post itself I assume

Only in Kinsellaland is a question transformed into a “call”. Calling for genocide is rather different from expressing frustration at the seeming hopelessness of the situation in Africa. But in the liar Kinsella’s hands that question is twisted into a call to action.

For some reason, known only to his dishonest little mind, Kinsella seems to have it in for Chris Selly and, lacking any better stick to beat him with, grabbed his links. Lame, but even more lame as the liar Kinsella sends me a few uniques from the link to me he has had for months on his own site. He used to have another link to me but took it down when he realized that it was a lie and enabled me to call him a liar forever more. Good news Warren, I have a screen shot of that too.

Makes you wonder why the National Post lets a liar and a cheap smear artist continue to write for them. Perhaps not for much longer.

Update: Chris Selly in a completely pleasant way hand the liar Kinsella his head. Edward Michael George dons his hazmat suit and points out that for donkey’s years Mr. K. linked to arch lefty anti-Zionist (and possibly anti-Semite - see I got the memo, there is a difference) Robert McClelland on his blog roll but lately has demoted him to jerk (though it is still a link, a concept which the liar Kinsella still has trouble grasping.)

Update II: Kate weighs in as do her commentors,

Warren Kinsella is the Tanya Harding of Canadian politics.

The Liar Kinsella whines some more

May 22, 2007 - A couple folks have asked me why I don’t ever show up in this.

Just a hunch, but I’d say it’s not unrelated to

this.

Adam’s certainly hired some interesting people!

Hi Farce in Chicago

After watching Scooter Libby go down on suppressed evidence and a he said/she said prosecution, my faith in trial by jury in America is pretty low. Which means I suspect that Conrad Black is likely to be convicted regardless of whether he did anything actually illegal. But the trial has revealed one, hitherto untapped, Canadian resource, Mark Steyn, court reporter:

So the auditors testified that the audit committee did it, and the audit committee testified that Radler and co did it, and Radler has now testified that Toronto did it. Maybe Toronto can be called to testify that Medicine Hat did it. macleans

While this is not at all funny for Black, Steyn’s writing makes much of the trial hilarious for the rest of us.

Oh, that Micheal Ignatieff

For those who’ve been wondering exactly what went wrong with Michael Ignatieff’s Liberal leadership campaign, I can now provide the terrifying answer: the party obviously brought home the wrong Michael Ignatieff. The guy the Liberals wanted was the stylish, erudite human rights expert from Harvard University. But the Ignatieff now in all the papers is apparently some totally different guy who’s been farming for the past few decades. colby cosh

I blame Bob Rae who should have alerted Canadians to the replacement of his former roomie with some farmer dude.
